‘Walking Dead’ Lawsuit Staggers Into Federal Court

[1]Robert Kirkman, the writer who penned the comicbook series that became the basis for AMC’s (NASDAQ:AMCX[2])  hit television series The Walking Dead, is now engaged in three lawsuits.

The first lawsuit, which was filed against Kirkman by artist and former collaborator Tony Moore, has now sprawled over to federal court, Variety[3] reports. Moore filed the suit in February, and in it accuses Kirman and his agents of resorting to fraudulent measures to coerce the artist to sign over his copyright interests. He’s also suing for breach of contract.

Although the original lawsuit was filed in Los Angeles Superior Court, it is staggering into federal court because that is where Moore filed his second suit against Kirkman.

In the second lawsuit, which was filed Tuesday, Moore is seeking a an official order declaring him as the joint author of The Walking Dead and other various other works under Kirman’s name.

“Kirkman is a proud liar and fraudster who freely admits that he has no qualm about misrepresenting material facts in order to consummate business transactions, and it is precisely that illicit conduct which led to the present lawsuit (and to Kirkman’s business ‘success’ generally),” Moore in the second lawsuit, according to The Hollywood Reporter[4].

Kirkman fired back with a countersuit earlier this year. The writer says Moore was overpaid by more than $43,000. Kirkman also claims Moore violated a part of their agreement pertaining to confidentiality.

Moore and Kirkman weren’t always rivals. In fact, the two were once close childhood buds. But since there is no love lost between the two comicbook crafters today, I’m guessing that in the event of an actual zombie apocalypse[5] — which is coming … never — one of the men would shoot the other in the foot and use him as bait.
