Ben & Jerry’s Sues Porn Company and Wins Round 1

Caballero Video has used the ice cream maker Ben & Jerry’s as inspiration for its pornographic Ben & Cherry’s DVD series. The earth-conscious ice cream chain sued the porn company and has won the first round.

On Thursday, a Manhattan court ordered the porn company to stop selling the items and to remove those products from the Internet, Reuters reported[1].

In addition to the names of the video series, which include titles like Boston Cream Thighs, Chocolate Fudge Babes and Peanut Butter D-Cups, the complaint says the DVDs’ packaging is too similar to Ben & Jerry’s packaging.

The order is a temporary blocking; the next court date regarding the case has been set for Sept. 12.
