India Bans Gay Sex

In a recent ruling, India’s Supreme Court banned gay sex[1] by overturning a ruling from a lower court.

The Delhi High Court ruled in 2009 that a law that made gay sex punishable with up to 10 years in prison didn’t apply to consenting adults. However, India’s Supreme Court ruled that the Delhi High Court had no right to change the law. This means that the law, Section 377, is now back in full effect, reports The Wall Street Journal.

In its anxiety to protect the so-called rights of LGBT persons and to declare that Section 377 IPC violates the right to privacy, autonomy and dignity, the High Court has extensively relied upon the judgments of other jurisdictions. Though these judgments shed considerable light on various aspects of this right and are informative in relation to the plight of sexual minorities, we feel that they cannot be applied blindfolded for deciding the constitutionality of the law enacted by the Indian legislature.

Some took to social media to express their outrage[3] with the court’s decision.

“I’m ashamed of being an indian,” “It’s a crime to be a person you want to be,” and “Nobody should face discrimination because of their sexual preferences. To be branded a criminal for this is absurd,” are a few Twitter (TWTR[4]) posts regarding the Supreme Court’s ruling.
