Court Tells Living 61-Year-Old You’re Still Legally Dead

Legally deceased man asks for death ruling to be changed


Donald Eugene Miller Jr. may be physically alive but as far the law is concerned, he’s dead.

The Australian reports that Miller disappeared from his Ohio rental in 1986 and was ruled dead in 1994. The 61-year-old man told the judge that he left town in 1986 due to alcoholism and he lost his job before his ex-wife asked for the death ruling and received death benefits for her and her two children.

Miller went to court to get his death ruling reversed but the judge was unable to do anything as the limit for changing a death ruling is three years. The judge responded by saying that there is “a man sitting in the courtroom, he appears to be in good health. I don’t know where that leaves you, but you’re still deceased as far as the law is concerned.”

The legally dead man wanted to get his life back together but he needed to be alive in order to get his Social Security number and driver’s license reinstated.
