Abercrombie & Fitch’s on-call shifts require workers to be ready to come in on short notice if they are needed. However, if the employee doesn’t get called in, they basically spend their day at home because they couldn’t make plans. However, New York State Attorney General Eric Schneiderman has warned that this could be illegal, reports The Consumerist.

Schneiderman’s argument against Abercrombie & Fitch, and other companies’, on-call shifts is that they don’t allow workers to truly use their time away from work. He said that this can get in the way of education and cause stress in their lives, U.S. News & World Report notes.

The first Abercrombie & Fitch stores that will stop using on-call shifts will be in New York. This will start in September and the company will move to phase it out of more locations in the near future. Employees will still be able to receive notification if an open spot in the schedule appears and they want more hours, reports The Consumerist.
