Alphabet’s (GOOG,GOOGL) Google Books can continue to scan books to create a digital library.

Google Books, Supreme Court, GOOG, GOOGLThat was the decision announced by the U.S. Supreme Court on Monday after it refused to hear an appeal from author’s claiming that the work was copyright infringement. This falls in line with the ruling made last year by the United States Court of Appeals for the Second Circuit concerning the matter.

The decision by the Supreme Court to not hear the appeal puts an end to a legal battle between Google Books and the Authors Guild that has been going on since 2005. The appeals court ruled that the collection only let users see small pieces of books and didn’t count as infringement, reports The New York Times.

“A copyright does not protect its holder against the listing of a work in either a traditional card catalog or in this vastly superior new form of search tool,” Google said in an earlier court brief obtained by The Wall Street Journal.
