The lawsuit against Apple claims that the company doesn’t fully disclose how much space a device really has when it’s bought and that the space is further reduced by iOS 8. The lawsuit claims that some devices can be short of as much as 23% of advertised space, reports ZDNet.

According to the lawsuit, upgrading to iOS can further reduce space by up to 1.3GB. The complaint claims that each gigabyte not available to users is the equivalent of 400 to 500 high-quality pictures. The lawsuit is seeking $5 million in damages from Apple, ZDNet notes.

Apple faced a similar lawsuit in 2007 over storage on its iPods. The issue then was that 8GB iPods only came with 7.45GB of storage. Apple won that case, reports CBS News.
