Burberry is suing JCPenney (NYSE:JCP) for allegedly ripping off one of its popular designs.
The company claims JCPenney has stolen its check pattern, which it first introduced in the 1920s. The design has since become one of the company’s most iconic symbols.
Burberry filed a trademark infringement suit against the retailer in a New York district court Tuesday, Feb. 9. The suit claims JCPenney copied its famed check on outerwear, adding that the knockoff versions are of lesser quality.
“Even though Defendants’ infringing products are of inferior quality, they appear superficially similar to genuine Burberry products,” the company’s complaint states.
“Defendants’ actions are intended to deceive and mislead consumers into believing that Defendants’ or their products are authorized, sponsored by or connected to [the company.]”
JCP stock is up 2% Wednesday.
