Microsoft Wants a Ban on Kyocera Android Phones

Microsoft (NASDAQ:MSFT) wants the sale of several Kyocera (NYSE:KYO) smartphones banned in the United States.

microsoft-kyocera-msft-kyoMicrosoft filed a complaint with the U.S. District Court for the Western District of Washington that seeks to ban Kyocera’s DuraForce, Hydro and Brigadier smartphones. The complaint claims that the devices infringe on some of the company’s patents and it’s seeking a trail by jury on the matter, reports PCWorld.

The Kyocera smartphones run on Google (NASDAQ:GOOG,NASDAQ:GOOGL) Android and are sold by several carriers and retailers in the U.S. Microsoft claims that Android infringes on some of its patents and it has a licensing program for smartphone creators that use the mobile operating system. It doesn’t have a deal with Kyocera for its Android smartphones, PCWorld notes.

“We respect Kyocera but we believe they need to license the patented technology they are using,” David Howard, the deputy general counsel for Microsoft, told ZDNet. “We’re hopeful this case can be resolved amicably.”
